Terms of Service

1. These Terms, and who we are
Inspirited.com (the “Service”) is operated by Viperion Media, LLC, a Utah limited liability company, at 5513 W 11000 N, Highland, UT 84003, United States (“we”, “us”). These Terms of Service (“Terms”) are a binding agreement between you and us. By creating an account or using the Service you agree to these Terms, to the Privacy Policy and to the Refund Policy, which are part of these Terms. If you do not agree, do not use the Service.
We may change these Terms. When we do, we update the date at the top of this document. For a material change we email the address on your account at least 14 days before the change takes effect. Using the Service after that date means you accept the new Terms. If you do not accept them, close your account before that date.
2. Who may use the Service
- You must be 18 or older. Confirming this when you create an account is a condition of using the Service. We do not knowingly allow anyone under 18 to use it, and we close any such account when we learn of it.
- One account per person, opened in your own name with accurate information.
- You may not use the Service if the law where you live forbids it, if you are barred from receiving services under United States law, or if we previously closed an account of yours for breaking these Terms.
- You are responsible for following every law that applies to you where you are.
3. Your account
Keep your password to yourself. You are responsible for everything done through your account. If you think someone else has used it, email support [at] inspirited [dot] com right away. We may suspend or close an account that breaks these Terms, puts other members or the Service at risk, or stays inactive for a long time (we give notice by email before closing an inactive account).
4. What Inspirited.com is, and what it is not
The Service is a tool for accountability and self-improvement. You declare promises and stake Spark on them, you talk with an AI mentor, you can ask an AI board to rule on a decision, and you can join a community of members who back each other.
The Service is not a financial, investment, legal, tax, accounting, medical, psychological, therapeutic, coaching-for-hire, or any other professional service, and using it creates no professional, fiduciary, or advisory relationship with us or with anyone. We are not licensed in any of those fields. No AI in the Service is.
5. The AI. Read this section.
Everything the mentors, the board, and the Oddsmaker say is generated by artificial intelligence. So are the odds, the rulings, the confidence figures, the remarks, and the nudges. The mentors are simulated characters. They are not people.
“AI MJ” is a character built on the published work of the founder of Inspirited.com, used with his permission. It is not him. The founder does not read, write, or answer conversations in the Service, and nothing an AI mentor says is a statement by him or by any real person. No other mentor is a real person or is connected to one.
AI output can be wrong. It can be incomplete, out of date, biased, or simply made up, and it can sound sure of itself while being wrong. We do not check it for accuracy before you see it.
Nothing the AI says is professional advice. It is not financial, investment, trading, tax, legal, medical, mental-health, relationship, parenting, or career advice. It is not a recommendation to buy, sell, or hold any investment, business, property, or cryptocurrency; to take, change, or stop any medication or treatment; to sign, break, or end any contract; to start or leave any job, business, or relationship; or to do anything else. The AI cannot see your full circumstances.
Odds, rulings, confidence figures, frameworks, and scores are arithmetic and opinion meant to help you think. They are not predictions, promises, or guarantees of any outcome.
Before you act on anything the AI says that involves money, health, safety, law, employment, or another person, verify it yourself and consult a qualified, licensed professional. The AI is not a substitute for one.
Emergencies. The Service is not for emergencies and cannot help you in a crisis. If you are in danger, thinking about harming yourself or someone else, or having a medical emergency, contact your local emergency number or a crisis line right now. In the United States, call or text 988.
6. Your decisions are yours
You decide what to do, and you alone are responsible for your decisions, your actions, and their results — including any loss of money, savings, investments, income, opportunity, time, health, or relationships. You agree that:
- you will not treat the Service or its AI as the basis for any decision, and you take on all risk if you do;
- we are not responsible for what you choose to do after using the Service, whether or not the AI’s output was accurate and whether or not you told the AI about your situation;
- the Service makes no promise that you will keep any promise, reach any goal, make or save any money, or achieve any result.
7. Spark, promises, and duels
Spark is a virtual point system inside the Service. It has no monetary value. It is not currency, property, credit, or an investment. It cannot be bought, sold, given, transferred, redeemed, cashed out, or exchanged for money, goods, services, or anything else of value, inside or outside the Service. Spark is forfeited when your account closes.
Staking Spark on a promise, backing another member’s promise, or entering a duel is a game mechanic. It is not gambling, wagering, or betting, because nothing of monetary value is at stake.
We set the rules of Spark — starting balance, odds, stakes, payouts, forfeits, pushes, lapses, and prizes — and we may change them, correct errors, and adjust or reset balances to keep the Service fair and working.
8. Community rules
Be honest and treat people decently. You are responsible for everything you post. You must not:
- harass, threaten, bully, or intimidate anyone;
- post hateful content, content that promotes violence, or sexual content involving minors, or encourage self-harm;
- share another person’s private information without their permission;
- impersonate anyone, or misrepresent who you are or who you are connected to;
- post spam, scams, pyramid or multi-level schemes, or unsolicited promotion of any product or service;
- post anything illegal, or anything that infringes another person’s rights;
- get around blocks, limits, or safety features;
- scrape or crawl the Service, or use bots, scripts, or other automated access;
- probe, scan, or attack the security of the Service;
- open extra accounts, or work with others, to manipulate Spark, odds, duels, standings, or any other part of the Service.
You choose what you share. Anything you post where other members can see it may be read by them. Use private promises and private notes for what you do not want seen.
The Service has block and report tools. We review reports at our discretion. We may remove content, restrict features, suspend accounts, or close accounts, with or without notice, when we believe these rules were broken or the Service or its members are at risk. We have no duty to monitor the Service, and we do not promise to act on every report.
9. Your content
You own what you write and upload. You give us a worldwide, non-exclusive, royalty-free license to store, copy, display, transmit, and process your content — including sending it to the AI providers named in the Privacy Policy — only as needed to run, secure, and improve the Service and as the Privacy Policy describes. This license ends when your content is deleted, except for copies in backups and records we must keep.
You promise that you have the rights to everything you upload, including your avatar and any text or documents you give a custom advisor.
Some of your content is visible to other members by design: your public name, your record figures, your duel results, and your place in standings. If you create a share link for a promise, anyone with that link can see that promise until you revoke the link.
We do not sell your content. We may use it in de-identified, aggregated form to understand and improve the Service. If you send us feedback or ideas, we may use them without any obligation to you.
10. Our content
The Service — its design, code, text, names, the mentor and Oddsmaker characters, the decision frameworks, and the Inspirited.com and Spark names and logos — belongs to us or our licensors. The founder’s books and other works remain his. We give you a limited, personal, non-transferable license to use the Service under these Terms. You may not copy, sell, rent, modify, reverse engineer, or build a competing product from any part of the Service, and you may not use the Service or its output to train or build an AI model.
11. Copyright complaints
If you believe content in the Service infringes your copyright, send a notice under the Digital Millennium Copyright Act to support [at] inspirited [dot] com or by post to Viperion Media, LLC, 5513 W 11000 N, Highland, UT 84003, United States. Include: your name, address, and email; the work you say is infringed; where the material is in the Service; a statement that you believe in good faith the use is not authorized; a statement, under penalty of perjury, that the notice is accurate and that you are the owner or authorized to act for the owner; and your physical or electronic signature. We may remove the material and tell the member who posted it, who may send a counter-notice. Members who repeatedly infringe lose their accounts.
12. Membership and payment
- Every new account starts with a free trial of Membership: 14 days from the day you create the account, no card required, nothing to cancel. When it ends, your account is on the free plan. Nothing you made is deleted. We email you shortly before the trial ends and again after it has ended.
- The free plan never expires. Membership adds features, at the prices shown when you buy, in United States dollars. We may change prices; we email you at least 30 days before a new price applies to a renewal.
- Payments are processed by Stripe. We never see your full card number. Membership renews automatically at the end of each period, monthly or yearly, until you cancel.
- Cancel any time from Settings. You keep Membership until the end of the period you paid for, then your account returns to the free plan. Nothing is deleted when you downgrade.
- Prices may not include taxes. Where the law requires us to collect tax, we do.
- If a payment fails, Stripe may retry it. If it cannot be collected, Membership ends.
- We may give Complimentary Membership at our discretion and may end it at any time.
- Refunds are governed by the Refund Policy.
13. Third-party services and links
The Service depends on companies we do not control: payment processing (Stripe), email delivery (Postmark), spam protection (Cloudflare), hosting, and the AI providers listed in the Privacy Policy. Their outages or changes can affect the Service, and we are not responsible for them. Members may post links to outside places, such as video calls or websites. We do not control those places and are not responsible for them.
14. Privacy
The Privacy Policy explains what we collect, how we use it, and exactly what is sent to an AI provider. It is part of these Terms.
15. Ending your account
By you. Email support [at] inspirited [dot] com from the address on your account and ask us to delete it. We delete it within 30 days, as the Privacy Policy describes.
By us. We may suspend or close your account for the reasons in the Community rules, for non-payment, when the law requires it, or if we shut down the Service. If we shut down the Service, we give at least 30 days’ notice by email where we practically can.
When your account ends, your Spark is forfeited, any Membership stops at the end of the paid period, and your content is deleted or de-identified as the Privacy Policy describes. Sections that by their nature should survive the end of this agreement do survive, including the sections on the AI, your decisions, Spark, your content, our content, warranties, liability, indemnity, disputes, and governing law.
16. No warranties
The Service is provided “as is” and “as available”. To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy, non-infringement, and uninterrupted or error-free operation. We do not warrant that AI output is accurate, complete, or suitable for you, or that using the Service will lead to any result.
17. Limits on our liability
To the fullest extent the law allows:
- we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost money, lost savings, lost investments, lost business, lost data, or lost opportunities, arising from the Service, from any AI output, or from your reliance on either, even if we were told such damages were possible;
- our total liability for all claims related to the Service is limited to the greater of the amount you paid us in the 12 months before the claim and 100 United States dollars;
- these limits apply under every legal theory — contract, tort, negligence, strict liability, statute, or otherwise.
Some places do not allow some of these limits. There, they apply as far as the law permits.
18. You will cover us
You agree to defend, indemnify, and hold harmless Viperion Media, LLC, its owners, and its people from any claims, losses, liabilities, and costs, including reasonable attorneys’ fees, that arise from your content, your use of the Service, your breach of these Terms or of any law, or decisions and actions you take after using the Service.
19. Disputes: arbitration, no class actions
Talk first. If you have a dispute with us, email support [at] inspirited [dot] com with the subject “Dispute notice”, your account email, and what happened. We each agree to try in good faith to resolve it within 30 days before starting any proceeding.
Binding arbitration. Any dispute not resolved that way is resolved by binding arbitration between you and us individually, administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitrator applies these Terms and Utah law. Arbitration takes place in Utah County, Utah, or by video, phone, or written submissions where the rules allow. The Federal Arbitration Act governs this section. Judgment on the award may be entered in any court with jurisdiction. Fees follow the AAA consumer rules.
No class actions, no jury trials. Claims may be brought only in your own name and not as a plaintiff or member of any class, collective, or representative proceeding. You and we each give up the right to a jury trial. If a court finds the class-action waiver unenforceable for a particular claim, that claim goes to court rather than arbitration, and the rest of this section still applies.
Exceptions. Either of us may bring an individual claim in small-claims court. Either of us may ask a court to stop infringement or misuse of intellectual property or unauthorized access to the Service.
Your 30-day opt-out. You may opt out of this arbitration agreement by emailing support [at] inspirited [dot] com within 30 days of creating your account, with your account email and a clear statement that you opt out of arbitration. Opting out does not affect any other part of these Terms.
Where the law does not allow it. If the law where you live does not permit binding arbitration or class-action waivers for consumers (for example, in parts of the European Union and the United Kingdom), this section applies only as far as that law allows, and you keep the right to bring a claim in your local courts.
20. Governing law and courts
The law of the State of Utah governs these Terms, without regard to its conflict-of-laws rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply. For anything not resolved by arbitration, the state and federal courts in Utah County, Utah have exclusive jurisdiction, and you consent to them. Mandatory consumer-protection laws where you live still apply.
21. Rights the law gives you
Nothing in these Terms removes a right the law where you live gives you and does not let you waive, including under European Union and United Kingdom consumer law and the Australian Consumer Law. Where a part of these Terms conflicts with such a law, that law applies to the extent of the conflict.
22. Other terms
- These Terms, the Privacy Policy, and the Refund Policy are the whole agreement between you and us about the Service.
- If any part of these Terms is found unenforceable, the rest stays in force. If we do not enforce a part, we may still enforce it later.
- You may not transfer your account or these Terms to anyone. We may transfer them to a company that takes over the Service.
- We are not responsible for delays or failures caused by events beyond our reasonable control.
- We send notices to the email address on your account. Send notices to us at support [at] inspirited [dot] com or by post to Viperion Media, LLC, 5513 W 11000 N, Highland, UT 84003, United States. You agree to receive notices, records, and agreements electronically.
- You confirm that you are not on any United States sanctions list and will not use the Service where United States export or sanctions law forbids it.
- California residents: under California Civil Code section 1789.3, you may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by phone at (800) 952-5210.
